BARNSTABLE — An evidentiary hearing in the murder case of a Virginia man accused of killing a fellow Coast Guard officer and seriously injuring her wife and a Bourne police officer a year ago has been scheduled for March.
At a motion hearing Friday in Barnstable Superior Court, Adrian Loya’s attorney, Drew Segadelli, requested that a doctor’s interview with his client be recorded on video.
Dr. Martin Kelly Jr. was hired by the prosecution to evaluate Loya, 32. Segadelli is arguing that Loya is not guilty by reason of mental disease or defect. Loya has already been evaluated by a state psychologist assigned to Bridgewater State Hospital, where he has been held since his arrest, and a private psychologist hired by Segadelli.
On Friday, an evidentiary hearing was scheduled for March 15, during which Kelly is expected to testify about why his interview shouldn’t be recorded.
Loya pleaded not guilty at his Superior Court arraignment July 14 to a charge of murder; 10 counts of possession of a large-capacity feeding device (ammunition magazine); three counts each of armed assault to murder, aggravated assault and battery and use of a firearm in the commission of a felony; two counts each of armed home invasion, armed assault in a dwelling and armed kidnapping with serious bodily injury; and one count each of burglary and assault on an occupant, arson of a motor vehicle, possession of a hoax device and assault and battery on a police officer.
